Lalique markets via its Internet website identified by the domain name sg.lalique.com (hereinafter referred to as the “Website”), as well as via its physical shop Lalique Paragon Boutique located at PARAGON #04-46 290 Orchard Road Singapore 238859 (hereinafter referred to as the “Shop”), product collections marketed under the brand name “LALIQUE” (hereinafter referred to as “Products” or “Product”).
2 | SCOPE OF APPLICATION OF THE PRESENT GENERAL TERMS OF CONDITIONS
2.1 - The present General Terms and Conditions (hereinafter referred to as “GTC”) apply to orders placed on the Website by an individual consumer for strictly personal and private use (hereinafter referred to as the “Client” or “you”/”your”) for a delivery of the Products in Singapore, Malaysia, Indonesia, Thailand, Vietnam, Cambodia, Laos, Philippines, Brunei, Myanmar, New Zealand, Christmas Island, Australia. The GTC also applies to orders for Products purchased at the Shop.
By placing an order on the Website, the Client represents and warrants that he/she is a bona fide end-user customer who has full capacity to enter into a contract with Lalique. By placing an order on the Website, or making a purchase at the Shop, the Client agrees to the GTC. The GTC can be printed from the Website. The GTC (insofar as is applicable to a purchase of the Products at the Shop), is also set out in the invoice.
2.2 - Lalique reserves the right to modify the GTC at any time, in which case the applicable version of said GTC shall be the one published on the Website when the Client places his/her order on the Website. Clients who do not agree with the applicable GTC at the date of their order have an option on the Website to express such disagreement and therefore interrupt the purchase before said order is confirmed. In the case of a physical purchase, the applicable version of the GTC shall be the one set out in the invoice.
3 | PERSONAL DATA AND DESIGNATION OF THE CLIENT
3.1 - To access the online sale service on the Website, the Client has the possibility, but not the obligation, to open an online account.
By placing an order and/or opening an account, the Client declares being a natural person ordering Products for non-commercial purposes, having the legal capacity to enter into contract and acting on his own behalf.
The account of the Client allows placing orders on the Website, consulting the state of the processing of his order and of the delivery of the Products, consulting the list of past online purchases, and having access to the Client’s personal data stored on the Website. The Client can modify said personal data when logged in on his/her account.
3.2 - To open an online account on the Website and/or to consult the state of the processing of his/her order and to receive potential commercial offers from Lalique, the Client fills in the fields in the registration form proposed by Lalique online with the following data (non-limited):
- Last name and first name,
- Phone number,
- Email address,
- Password,
- Delivery and Billing addresses.
By making his/her email address and phone number available on the Website, the Client agrees to receive at his/her email address information relating to his/her orders placed on the Website, and the processing of said orders.
3.3 - If the Client opens an online account, he/she will choose a security password that shall be strictly confidential.
An email confirming the opening of an online account shall be sent to the Client at the email address provided when filling the online form.
To access his/her online account, the Client must use his/her email address as a username and his/her password.
The Client who loses his/her password can reset it by using his/her email address used as a username.
3.4 – Personal data: Lalique undertakes to keep the personal data collected confidential and to use it in accordance with the Personal Data Protection 2012 of Singapore and the regulations made thereunder.
Said personal data shall be used for:
- Processing the online orders and all contractual obligations,
- After-sale services,
- Customer relationship management such as informing the Client of any promotional operation, if the Client agreed beforehand to receive such requests.
They shall be kept in a form enabling the persons concerned to be identified for a period which does not exceed the time necessary for the purposes for which they are collected and processed.
By providing his/her personal data to Lalique, the Client expressly agrees that Lalique may communicate the personal data to its partners in charge of the processing of the orders placed online, of the delivery of the Products and of the after-sale service.
By filling the Lalique online form, when placing the order and / or opening an online account, the Client can choose to receive commercial offers from Lalique, companies of the same group and / or commercial partners.
The Client can exercise at any time his/her right of access to the data, and his/her rights of opposition, obtaining, deletion, portability, correction, suppression of his/her personal data.
He/she may also object for just cause to such use or data processing.

The Client acknowledges and agrees that if Lalique or its assets would be sold, Client’s information would be part of the transfer of assets.
4 | TERMS FOR PLACING AN ORDER
4.1 - All the Products offered for sale on the Website are presented on a file including a photographic image of the Products and information such as dimensions and the all tax included price of the Product. All Products purchased at the Shop shall conform with the photographic image and information as set out in the file presented on the Website or with the sample or model displayed at the Shop (if relevant). Products are offered for sale as long as they are available and within the limits of available stock. Pictures are the most accurate as possible but Lalique does not warrant a perfect correspondence with the Product(s) selected for purchase (like colours).
By clicking on the link "Add to Cart", the Client places the Product in his/her "Cart" in the quantity chosen.
After placing one or more items in the "Cart", the Client can continue shopping by clicking on the shopping cart icon at the top right of the screen.
4.2 - The Products selected by the Client are listed in this "Cart" with the following information available:
- A picture of each Product selected by the Client,
- The title of the Product and key information on the Product (size and / or colour),
- The unit price, all tax included, for each Product selected by the Client,
- The number of items chosen for each Product,
- A subtotal price per Product,
- A total price all tax included, excluding packaging and delivery charges.
The Client is asked to check the list of Products to modify or accept it by clicking on the link "Proceed to checkout".
4.3 - Once the Client has clicked on the "Proceed to checkout" button, a page opens, and the Client is invited to proceed with the order:
- Either without opening an online account,
- Either by opening an online account beforehand
- Either by logging in: typing his/her email address as a username and his/her password if he/she has opened an account before.
The Customer is invited to review the Terms and Conditions, which are accessible at the bottom of the screen throughout the payment process, as well as the detailed summary of their order, including the selected items, the total price including all taxes and shipping/packaging fees.
4.4 - The Client who accepts his/her order as described shall pay with his/her credit card (Visa, MasterCard, American Express), or by PayNow to UEN201107367W, and is asked to enter his/her billing address. If the billing address is the same as the delivery address, the Client may choose to use the same address for both delivery and billing.
4.5 - Only after confirmation in writing by Lalique, shall the order be placed and effective.
Before sending the confirmation order, Lalique shall retain the right to refuse the order for just cause including when the selected article is no longer available for sale or if Lalique is in dispute with the Client regarding payment of an order placed previously. Lalique confirms each order by email to the Client with the following information:
- Order reference,
- Delivery and Billing addresses,
- The Product(s) ordered,
- Total price all taxes included, including packaging and delivery charges, paid by the Client.
If we are unable to accept your order, we will inform you of this by email or post and will not charge you for the Product. This might be because the Product is out of stock, because of unexpected limits on our resources which we could not reasonably plan for, because we have identified an error in the price or description of the Product or because we are unable to meet a delivery deadline you have specified.
4.6 - Lalique shall keep the written proof of the sales contract entered into with the Client for a period of time of 10 years starting on the delivery of the Products.
Client can ask for a copy of said contract by email or post, to the customers’ relations service of Lalique at the postal address mentioned at Article 1 of the GTC. However, Lalique strongly recommends to the Client to keep copies of its order and more generally information related to the purchase.
4.7 - Title to the Products shall remain vested in Lalique and shall not pass to the Client until Lalique has received the complete payment of the overall price. The delivery of the Products ordered shall not occur before the complete and effective payment of the price.
4.8 - Lalique verifies each order placed on the Website. Such control aims at protecting Lalique from abusive practices set up by fraudsters. Lalique may ask the Client for any necessary documents to carry out the order: address proof at the Client’s name or at the name of the person indicated for the delivery, etc. Such request shall be made by email.
4.9 - We may need certain information from you so that we can supply the Products to you, for example, additional address details. If you do not give us missing information within a reasonable time of us asking for it, or if you give us incomplete or incorrect information, we may either end the contract or make an additional charge of a reasonable sum to compensate us for any extra work that is required as a result. We will not be responsible for supplying the Products late or not supplying any part of them if this is caused by you not giving us the information we need within a reasonable time of us asking for it.
4.10 - Pre-orders.
The Client may place one or more pre-orders for certain upcoming or currently unavailable Products, thereby guaranteeing the availability of the Product(s) upon restock.
For such pre-orders:
- An estimated shipping timeline is clearly indicated on the product page and reconfirmed in the order confirmation email sent via Shopify.
- Once the Product is ready to be dispatched, the Client will be notified by email or phone.
- If a single order includes both in-stock Products and pre-order Products, the entire order will be shipped once all items are available. Lalique does not offer partial or staggered shipping for a single order.
- Should the Client wish to receive the in-stock Product(s) without waiting for the pre-ordered item(s), we recommend placing two separate orders to facilitate separate deliveries.
4.11 – Pick-up in Store
The Client has the option to select "Pick-up in Store" as the delivery method during checkout, allowing him/her to collect his/her order at the Lalique Paragon Boutique in Singapore.

- The Client will be informed by email or phone when the order is ready for collection within 48 hours after order confirmation.
- To collect the order, the Client must present the order confirmation email and a valid photo ID (passport, national ID card, or equivalent).
- If the order is not collected within fourteen (14) calendar days, it will be automatically cancelled and refunded to the original method of payment.
- A Client cannot combine delivery and in-store pick-up within a single order. If the Client wishes to have certain items shipped and others picked up in-store, he/she must place two separate orders.
5 | PRICE
5.1 - The price of each Product (denominated in Singapore dollars) is mentioned on its designated file on the Website for delivery within Singapore, the price will be inclusive of Singapore goods and services tax at the prevailing rate, but for delivery outside Singapore, the price will not include Singapore goods and services tax. Prices exclude the import duties in the country of delivery (if applicable) (which shall be the responsibility of the Clients to settle) and packaging and delivery charges. Prices on our online store are converted into the currency of our Clients based on their location and are automatically adjusted according to current market exchange rates. The selling price may therefore vary slightly over time.
Packaging and delivery charges are indicated to the Client on the web page listing the Products and submitted for his/her approval before the order is completed. The amount of these charges depends on the physical characteristics of the Products, the order amount, and the shipping address.
The prices of Products purchased at the Shop is inclusive of Singapore goods and services tax at the prevailing rate. Home delivery charges in Singapore (if applicable) may be charged (or waived at the discretion of Lalique).
5.2 - Lalique Crystal Singapore Pte Ltd reserves the right to modify the price of the Products at any time. The price accepted by the Client when validating his/her order is firm and shall not be modified by the Client.
6 | PAYMENT
6.1 – For Products purchased on the Website, the full overall price must be paid to Lalique before the order will be processed.
For Products purchased at the Shop, if the Products are immediately available for collection or delivery, the Client shall pay the full price upon purchase.
For Products that requires time for production or which are custom-made, the Client shall pay a deposit of a minimum of 50% of the order value (the quantum of deposit to be determined by Lalique) to confirm the order. The balance of the order value shall be paid by the Client on or before the dispatch of the Products to the Client or before the Products are collected by the Client.
Deposit paid is not refundable under any circumstances. If the Client does not complete the purchase, Lalique shall have the right to cancel the order and forfeit the deposit.
6.2 – The Client can pay by PayNow to UEN201107367W or by credit card payment. If the Client pays with a credit card, the Client pays by transmitting:
- For Visa® and MasterCard® credit cards: The 16-digit number of his/her credit card, its expiry date and the security number indicated on the back of the card,
- For American Express® credit cards: The 15-digit number of his/her credit card, its expiry date and the security number indicated on the front of the card.
Following credit cards are accepted:
- Visa®,
- MasterCard®,
- American Express®.
The Client certifies that he/she is not prohibited from using a credit card for payment of his/her order and that this mean of payment grants Lalique access to the sum necessary for the payment of the order.
6.3 - Transactions made on the Website are secured by the SHOPIFY PAYMENTS payment system, which the Client expressly acknowledges and accepts. The Client guarantees to Lalique that he/she is fully authorized to use the credit card for the payment of his/her order. Lalique cannot be held responsible for any fraudulent use of the credit card used for the payment of the Products by the Client.
If the transaction could not be executed and the Client payment account could not be debited, the sale would be immediately stopped and the order of the said Products would be canceled.
Lalique suggests to Clients to keep the receipt from the bank after completion of the transaction and more generally the information related to the purchase.
Lalique informs the Client that it does not have access to any confidential information related to the payment methods used by the Client, even if the Client chooses to save their payment data on the payment module of the Website.
7 | DELIVERY
7.1 - Please consult our delivery times and fees on the Shipping page, accessible in the footer. Products bought on the Website shall be shipped to the delivery address given by the Client at the sole risk of the Client. If the Client wishes to insure the Products in transit, the Client may do so on his/her own account.
7.2 In order for the Products to be shipped to the Client, the Client shall fill in the fields of the Lalique online form proposed with the following data:
- Last name and first name,
- Company,
- Phone number,
- Delivery address (1st line),
- Delivery address (2nd line),
- City,
- Postal code,
- Country.
7.3 - The Client will be notified of the dispatch of his/her order by e-mail. The Client will be informed of the follow-up of his delivery by the logistics provider (DHL Express, Federal Express or such other courier company engaged by Lalique at its absolute discretion).
Should the Client be absent at the time of delivery, the shipping company shall send an email, SMS or calling card to the Client with the address of a drop-off location where the Client can collect the Products.
7.4 - The delivery is deemed effective when the Products ordered are delivered to the Client by the shipping company and the Client has signed the delivery receipt. The delivery is also deemed effective when the delivery receipt is signed by a relative of the Client (including but not limited to his/her husband/wife/partner, children, parents) or by a caretaker, or a neighbor of the Client.
The Client is responsible for verifying the Products delivered are in an acceptable condition and to express any proper reservation to the delivered Products in writing and/or to refuse the delivery if it appears to have been opened or if it bears signs of damage.
Said reservation must be written on the delivery receipt and transmitted to the customers’ relations service of Lalique by email within 24 hours of the delivery, providing the username of the Client and the order reference. The provisions above apply without prejudice to the application of the provisions of Article 10 of the GTC hereafter relating to the right of exchange of the Client.
7.5 - Despite the constant efforts of Lalique to give complete customer satisfaction, Lalique remains exposed to risks due to the delivery of parcels.
If our supply of the Products is delayed by an event of force majeure, then we will contact you as soon as possible to let you know and we will take steps to minimize the effect of the delay. Provided we do this we will not be liable for delays caused by the event, but if there is a delay of more than 30 days after the delivery deadline, you may contact us to end the contract and receive a refund for any Products you have paid for but not received, including initial packaging and delivery charges. In this Article 7 and Article 15, the term “force majeure” means an event caused by an act of God, epidemic, earthquake, fire, flood, riot, civil disorder, terrorism, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery or other substantially similar events beyond the control of Lalique.
The delivery deadline is 30 days from the date of order confirmation by the Client.
If a non-compliance with the delivery deadline of more than 30 days occurs, not attributable to a case of force majeure or a default of payment, Client shall be entitled:

The references of the order should be mentioned.
In this case, Lalique will refund the Client the monies received by Lalique from the Client for his/her order within 30 days of receiving the request for cancellation of the order. The refund excludes any import duties in the country of delivery which may have been paid by the Client.
- Alternatively, if the Client does not wish to cancel his/her order, he/she should inform the customers’ relations service of Lalique about this delay by e-mail or telephone, mentioning the references of his/her order. Lalique will then make the necessary investigation to determine the cause of the delay, and if necessary, organize the resending of the Product. In the event of receiving a duplicate of the Product following its resending by Lalique, the Client agrees to refuse the package from the shipping company or return it at his/her expense.
In either case, Lalique reserves the right to ask the Client to sign an affidavit or declaration of non-receipt of his/her order.
7.6 - As stated in Article 5 of the GTC, packaging and delivery charges depend upon the physical characteristics of the Products ordered, the order amount, and the shipping address.
7.7 - If, after a failed delivery to you, you do not re-arrange delivery, we will contact you for further instructions and may charge you for storage charges and any further delivery charges. If, despite our reasonable efforts, we are unable to contact you or re-arrange delivery or collection we may cancel the order and forfeit the monies paid by you for the cancelled order.
7.8 – If the Client opts for the pick up in store option, the Client must collect the Products from the Shop (or such other Lalique boutique chosen for pick up by the Client) within 3 months of the date for pick up, failing which Lalique will (after notifying the Client) levy a storage charge for storing the Products. Such storage charge must be paid before the Products can be collected. If the Client fails to collect the Products within 6 months of the date for pick up, Lalique reserves the right to cancel the order, forfeit the monies paid by the Client for the cancelled order and dispose of the Product(s) ordered as Lalique deems fit.
8 | AVAILABILITY OF THE PRODUCTS
8.1 - The availability of each Product is checked and confirmed by Lalique before the Client places his/her order.
Despite the care taken by Lalique to the managing of the Product stocks and the information displayed on the Website, a Product may be unavailable after placing of the order by the Client and confirmation by Lalique, due to the fact that several orders can be placed simultaneously, a mistake can occur in the processing or a Product in store can appear to have sustained damage.
In that case, Lalique shall send an email to the Client to make one of the following election of his/her choice:
- Either to wait for the Product to be available again,
- Either to cancel the order and order another Product available on the Website,
- Either to cancel the order and get a refund of the order.
8.2 - When several Products have been ordered by the Client, and one or more Products in the order are not available in stock, then the order may be delivered partially. In this case, Lalique will send an e-mail to the Client to propose:
- Either to confirm the partial delivery of his/her order and to wait for the other Product(s) to be available.
- Either to confirm the partial delivery of his/her order and to cancel the other Product(s) ordered. He/she will be invoiced only for the price of the delivered Products. Lalique will refund the Client for ordered Products not available in stock.
- Either to cancel the entire order and receive a complete refund.
If the Client refuses or does not answer within 7 days, the order shall be cancelled and Lalique shall refund the Client with the total price of the Product initially ordered including its packaging and delivery charges.
9 | CONFORMITY OF THE PRODUCTS
9.1 – The Client acknowledges and agrees that although Lalique makes its best efforts to ensure that the photographic image of the Products on each file is as close as possible to the perception of a Client who would see the Products on display at the Shop, the technical constraints of online displaying and photographing in a digital format can make the perception of a Client to be different from that of a Client seeing the Product at the Shop. Therefore, unless the parties have agreed in writing that the Products shall correspond with the sample or model shown in the Shop, the Client agrees he will not object to Products that do not conform with the actual Products seen in the Shop so long as they conform to the photographic image of the Products on file.
10 | RIGHT OF WITHDRAWAL AND RETURN
10.1 – Right of Withdrawal
The Client has the right to withdraw from the purchase and return the Products within 14 days from the date of delivery or in-store purchase. This right can result in either a refund or an exchange, depending on the place of purchase.
- For online purchases made on sg.lalique.com, the Client may choose between a refund or an exchange.
- For purchases made in physical Lalique boutiques, only exchanges are permitted in accordance with the store's return policy. No refunds will be issued for in-store purchases.
For online orders, the Client must notify Lalique Customer Service of their intention to withdraw from the purchase within the 14-day period. The notification must include the Client’s full name, order or purchase reference, phone number, and email address.
10.2 – Conditions of Return
Products must be returned in a new and unused condition, in their original packaging, with all protective materials, tags, stickers, accessories, and documents intact.
Lalique will not accept any return if the Products are incomplete, damaged, used, or altered in any way.
The following items cannot be returned or exchanged:
- Customized or bespoke Products (e.g., engraved items)
- Perfumes, candles, and diffusers if the seal has been broken
- Pierced earrings
10.3 – Return Process
For online orders, Products must be returned using the return form included in the parcel, to the following address:

The cost and risk of return shipping are borne entirely by the Client.
10.4 – Exchange Policy
The Client may request an exchange within 14 days from the date of delivery or purchase.
- For online orders, exchanges are available for items of equivalent value. If the Client wishes to exchange for an item of a different value, the initial item will be refunded, and a new order must be placed on sg.lalique.com.
- For in-store purchases, only exchanges are allowed. If the returned Products meet the return conditions, Lalique will issue a credit note for the equivalent value of the returned Products (excluding packaging and delivery charges). This credit note is valid for six (6) months from the date of issue and may be used to redeem replacement Products of equivalent value.
Any new items collected or delivered in exchange will follow the same delivery terms and conditions as the original purchase. The Client will remain responsible for any packaging and delivery charges, and for any applicable import duties.
10.5 – Refund Process (Online Purchases only)
If the returned Products meet the return conditions, Lalique will issue a refund of the Product price (excluding packaging and delivery fees) within 14 days of the Client exercising the right of withdrawal.
11 | PRODUCT GUARANTEE
11.1 - The Client enjoys all product guarantees provided for by Consumer regulations in force in Singapore when the Client places the order and upon delivery.
Lalique agrees to deliver a Product which conforms with the contract between the parties and to be responsible for any lack of conformity which exists upon delivery. Lalique also agrees to be responsible for any lack of conformity caused by the packaging or the assembly instructions, or the installation provided Lalique has assumed responsibility therefore or had it carried out under Lalique’s responsibility.
To conform to the contract, the Product must:
1) Be suitable for the purpose usually associated with such a Product and, if applicable:
- Correspond to the description of the Product given by Lalique and have the features that Lalique presented to the Client in the form of a photographic image of the Products on file on the Website or a sample or model (if relevant);
- Have the features that the Client might reasonably expect the Product to have considering the public statements made by Lalique, including in advertising and labelling the Product;
2) Have the features defined by mutual agreement between the parties or be suitable for any special requirement of the Client which was made known to Lalique and which the latter agreed to;
3) Be of a satisfactory quality.
Lalique agrees to be responsible if a defect is detected in the Product within six (6) months after its delivery to the Client if the defect is one that renders the Product not in conformity with the contract description of the Product, or that renders the Product to be of an unsatisfactory quality and unfit for its intended use, or that so impairs its use that the Client would not have bought it, or would only have given a lesser price for it if he/she had known of the defect.
11.2 - The Client can send any claim regarding the product guarantee to the customer service of Lalique, at the postal address mentioned at Article 1 of the GTC, with a documentary and supporting evidence of his/her purchase.
The claim shall then be assessed by Lalique as to whether the Client’s claim has been substantiated.
If the Client’s claim has been substantiated by Lalique, Lalique shall propose to the Client, at the Client’s choice:
- Either the replacement of the Product if a replacement Product is available (Lalique to bear the cost of the redelivery the Product to Lalique and of the delivery of the replacement Product to the Client and the Client to bear the import duties (if applicable) for the replacement Product),
- Or a refund of the price (Lalique to bear the cost of the redelivery of the Product to Lalique, if necessary).
12 | INTELLECTUAL PROPERTY
12.1 – All the content of the Website, be it visual, graphical or sound, or the mark(s) Lalique and all other marks of Lalique and/or its related entities, whether or not composed of the words "Lalique", as well as all intellectual property rights which may be attached to the products (such as designs, images, texts and logos), whether registered or unregistered, (the "Intellectual Property Rights") are and will remain the exclusive property of Lalique and/or its related entities.
The copy or use, in whole or in part, of the aforesaid content without prior written consent of Lalique constitutes a violation of the Intellectual Property Rights owned by Lalique and/or its related entities and involves its perpetrator's civil and/or criminal liabilities.
The GTS do not imply any assignment of Intellectual Property Rights whatsoever to the Client.
12.2 - No link to the Website shall be set on another website without prior written authorization of Lalique.
The Website may offer links to third party websites operated by other companies and implemented with the authorization of Lalique. However, Lalique is not able to verify the content of third party websites and, as a consequence, does not accept any responsibility therefor. The access and the use of third party websites are at the sole responsibility of the user.
12.3 - Notice Regarding AI-Generated Content
Some of the images and visuals used on the Website have been generated using artificial intelligence (AI). These AI-based contents result from advanced technologies we employ to provide a unique visual experience. Despite the computer-generated nature of these images, we ensure that they meet our high-quality standards and reflect the aesthetics and exclusivity of our brand. We value your feedback. If you have any questions or comments about the AI-generated content on the Website, please do not hesitate to contact us.
13 | DIGITAL PRODUCT PASSPORT
13.1 - What is the Digital Product Passport?
Lalique offers Client the opportunity to access information about certain collections by utilizing the Aura Blockchain Consortium’s technology based on Ethereum and Polygon accessible directly on their smartphones via an NFC tag. The Digital Product Passport (DPP) enables Client to access exclusive information about the Product and its entire supply chain. It provides insights into material origins, compliance processes, as well as quality, sustainability, and transparency aspects that uphold the Product's value and identity. The DPP also enriches the product experience with visual, audio or textual elements such as NFTs.
13.2 - How to obtain the DPP?
Lalique adds a credit card with an integrated NFC chip to the product packaging. When Client holds his/her smartphone to the NFC chip, he/she is forwarded directly to the digital certificate of authenticity via a secret link. The Client can also download the certificate to his/her Apple or Android wallet (similar to a flight ticket, etc.). In addition, a so-called "Collectible" (a digital twin of the product, saved as an NFT) can be created.
13.3 - Claim Process:
Please follow the steps below to claim your digital certificate of authenticity:
1. Tap the NFC chip on the credit card with your phone and open the notification that appears on your screen. If you have difficulty in activating the NFC chip, please refer to our “How to read an NFC Chip” section for assistance.
2. When the page is opened, you will be invited to create an account to claim your certificate of ownership.
3. After logging in or creating your new account, click on the “Claim Your Certificates” button to start the claim process. The process may take a few seconds
4. In the next step, Client has the option of downloading various digital assets (e.g. the digital twin of the product as NFT, saving the certificate in the native mobile wallet or downloading the certificate as a PDF)
13.4 - The Aura Blockchain Consortium provides the solution for Lalique to issue this certificate. The content of this certificate is under the sole responsibility of Lalique.
14 | RULE OF EVIDENCE
The Client expressly accepts and acknowledges that messages sent by e-mail, Log files hosted on the servers of Lalique or its technical service providers, statistical data generated and communicated by Lalique, accessible electronically shall have the same evidential value as hard copies, letters and documents sent by post, except where a registered letter with acknowledgement of receipt is expressly required.
15 | LIABILITY AND DISPUTE
15.1 - Lalique shall not be held liable for complete or partial breach of contract in case of force majeure, wrong of the Client, payment incident, or in case of unpredictable and insurmountable act of a third person.
Lalique cannot be held liable for any potential damage that can occur when browsing the Internet such as, especially, a connection failure, the loss of data, access by a third party to the data on the computer of the Client, or risks of viruses or unwanted software installing.
15.2 - In case of breach of the contract by the Client under the provisions of the GTC, such as the transmission to Lalique of false identification information, the use of invalid means of payment or illegal use of a third party’s means of payment, Lalique reserves the right to delete the online account of the Client and to cancel any pending order without prejudice to any claim for damages.
Lalique also reserves the right to refuse any order from a Client with whom such breaches of contract would have occurred.
15.3 - In case of dispute, the Client can send a claim to the customers’ relations service of Lalique, at the postal address mentioned at Article 1 of the GTC, in order to find an amicable solution.
15.4 - If such dispute cannot be settled and resolved through mutual negotiation pursuant to Article 15.3, then the parties agree first to attempt to settle such dispute and reach an amicable solution through mediation at the Singapore Mediation Centre in accordance with the Mediation Procedure for the time being in force. The parties agree to participate in the mediation in good faith and undertake to abide by the terms of any settlement reached.
15.5 - If the dispute has not been resolved within 3 months of referral to mediation either party is free to resort to litigation. In this respect, the courts of Singapore shall have exclusive jurisdiction to resolve the dispute and the laws of Singapore (without reference to its conflict of laws principles) shall be the applicable law that shall apply to any dispute between the parties arising out or relating to an online purchase on the Website or any physical purchase from the Store. The application of the United Nations Convention on Contracts for the International Sale of Goods, and the Uniform Law on the Sale of Goods and the Uniform Law on the Formation of Contracts for the International Sale of Goods, to the contract between the Client and Lalique are hereby expressly excluded. The application of the Contracts (Rights of Third Parties) Act 2001 of Singapore is hereby expressly excluded.
15.6 – The GTC constitutes the entire agreement between the Client and Lalique regarding the Client’s purchase of the Products from Lalique and supersede any other conditions of sale.
15.7 – In the event that any provision of the GTC shall be determined to be partially void or unenforceable by any court having jurisdiction and for any reason whatsoever, it shall be void and unenforceable to that extent only and no further and the validity and enforceability of any of the other provisions of the GTC shall not be affected.
